When Is An Image 'Manipulated Enough' To Become An Original Creation?

Images manipulated using programs like Photoshop or the GIMP are a familiar sight online. Indeed, the ease with which images can be modified has led to an amazing flowering of this new branch of the visual arts. But like much in the digital world, this brings with it problems. Here, for example, is the interesting case of a competition on the MINI Space site, which is run by BMW as an oblique form of marketing for its Mini car. An article on the PetaPixel photography blog explains what happened when the site invited submissions on the theme of "check-mate" (pointed out to us by @copyrightgirl). Here's "PapiloChessBoard", the photomanipulated image that gained the winner a MacBook Pro laptop:

Just as the original term of copyright has been constantly extended from the original 14 years in the Statute of Anne, so the the scope of intellectual monopolies has been widened by the introduction of new ways in which people assert ownership of abstractions. Here's the latest idea: a right to protect your image.

God Bless Patent Trolls....

....for continuing to demonstrate just how mind-bendingly stupid software patents are:

SINGAPORE--A local company has laid claims to a technology that Web sites across the globe deploy to link images to other Web pages, and sent out notification letters to several companies demanding to be paid licensing fees.

Dubbing itself "pioneers of visual search technology", Vuestar Technologies said it owns the patent to the technology that enables "Internet searching via visual images".

In sum, the company implied that any Web site that uses pictures and graphics to link to another site or Web page will need a license from Vuestar.

"Those who use visual images which hyperlink to other Web pages or Web sites...whether on the first page or subsequent pages of a Web site require a Vuestar 'license of use'," the company said on its site.

Snap Decision

As you have probably noticed, there are no images on this page. This is largely to speed the loading: with pix, it would take much longer, and generally slow down the experience of reading the blog.

Clearly, though, much of the Web is graphical in nature, and many Web pages are visually attractive. So it's a pity not to be able to show this as an enticement to explore the links in these posts further.

But I think I've found the solution. I've decided to install Snap Preview Anywhere on these pages. When you move the mouse pointer over an external link, you should see a small floating image of the page linked to (you need Javascript enabled for this to work). To follow the link, either click on it as usual, or click on the image of the page it leads to. More details here.

I hope you find this useful - I know I do on other sites that have installed it. If you don't, you can turn it off by clicking on Options in the floating window, and disabling it.

Update: Following suggestions in a comment (for which thanks), I've now activated Snap Preview for internal links. And you'll notice a small search box in the pop-up window: this leads to Snap's search engine, which also uses its preview technology to good effect. Feedback on these moves is always welcome.
