Once Again Top Downloaders Are Top Spenders, According To UK Gov't Study

If there's one clear trend that has emerged in recent years, it's that those who download and share unauthorized copies of files the most also tend to be the most avid purchasers of similar material. This completely negates the copyright industry's rhetoric that people who share files are just a bunch of freeloaders, suggesting instead that it's more a matter of sampling materials before going on to buy. It also implies that instead of seeking to punish such downloaders, the copyright companies should actually try to nurture them as potentially their best customers.

Pig-headedness, not Piracy, Killed Recorded Music

An extremely feeble article in the Guardian parrots the recording industry's line that piracy is killing music:

Global recorded music sales fell by almost $1.5bn (£930m) last year as digital piracy continued to take its toll on the industry, with the UK losing its mantle as the third-largest music market after "physical" sales of CDs collapsed by almost a fifth.

Sorry, I think I missed the proof that this fall was *caused* by piracy: any evidence? No, I thought not. Whereas there is growing research that unauthorised sharing actually increases sales (see the list of examples and links in this post.)

Perhaps the problem is rather that the sales being driven by this unauthorised sharing just aren't being generated fast enough to compensate for the overall decline in the recorded music industry. After all, there's nothing that says it must always grow. Maybe people are just fed up with its antics now that there are plenty of other kinds of music available (under cc licences, for example.)

In fact, there's a rather telling graph that the IFPI has kindly provided. It shows, of course, the decline in total sales of recorded music, breaking it down by "physical", "digital" and "recorded rights". The last of these is pretty much constant, while digital is growing at a modest pace.

But as is so often the case, this graph tells us something quite different from those "obvious" figures - and something rather interesting: that digital sales didn't really exist before 2004.

Thank about it: it took five years after Napster was created before the recording industry finally began to acknowledge the existence of a revolution whose inevitability was obvious to anyone who had spent a few hours online. Is it any wonder that people got fed up with the exorbitant pricing and inconvenient packaging of CDs, and despaired of ever being treated fairly with reasonably-price downloads?

In effect, it was the industry's pig-headed refusal for half a decade to sell people what they wanted that has driven users away. If some - even many - of them turned to unauthorised downloads, is it really any wonder? So before we blame the pirates, how about a word or two for the owners of those heads?

Why Music Companies are Doomed Regardless

One of the favourite tropes in the music industry is that they'd all be rolling in it like the good old days if it weren't for those nasty people downloading music for free. Here's a perceptive analysis that explains why that isn't so:

the newspaper industry is in the same death spiral as the recording industry, without the lawbreaking that’s commonly blamed for the recording industry’s troubles. And it seems to me that this poses a philosophical challenge to DeLong’s theory that the problem is a lack of respect for “property rights.” The decline of the newspapers is clearly a story of technological progress producing increased competition and entrepreneurship—precisely the sort of thing libertarians normally celebrate. The news business has gotten far more competitive over the last decade, and we’re now seeing a normal shake-out where the least efficient firms go out of business.

I think the fact that this is happening in an industry without a piracy problem should give us second thoughts about blaming the decline of other copyright industries on BitTorrent. The newspaper example suggests that even if we could completely shut down peer-to-peer networks, we should still expect the recording industry to decline over time as consumers gravitate toward more efficient and convenient sources of music. Piracy obviously accelerates the process, but the underlying problem is simply this: the recording industry’s core competence, pressing 1s and 0s on plastic disks and shipping them to retail stores, is rapidly becoming pointless, just as the newspaper industry’s core competence of pressing ink on newsprint and dropping them on doorsteps is becoming obsolete. Not surprisingly, when a technology becomes obsolete, firms who specialize in exploiting that technology go out of business.

How to Make Money from Music

Someone's managed:

it was recently revealed that rock gods Aerosmith have made more money off of their crummy co-branded version of Guitar Hero (I say crummy because reviews of the game have been lackluster) then they have on any album that the band has released to date. The revelation recently came from Activision chief executive Bobby Kotick and it unscores a number of really interesting points. First off, Guitar Hero: Aerosmith is nothing more than a "greatest hits" montage for the band, with a bunch of indy band songs sprinkled in for variety. Putting out the game cost Aerosmith nothing more than their signature, agreeing to allow Activision to use their music. Secondly, it proves the consumer is still interested in paying for music. They just don't want to buy CDs or single tracks anymore. They want interactivity, add-ons, special content and video games. According Microsoft gaming chief Robbie Bach, more than 60 million tracks were downloaded for Rockband, Guitar Hero and Lips over Xbox Live in 2008.

The second point is crucial: you've just got to offer stuff in the form that punters want. Is that so hard to understand for the music business?

More Evidence that File Downloaders Buy *More*

One of the central fallacies in the argument that sharing is bad for business is the idea that every file downloaded is a sale lost. In fact, there is growing evidence that the contrary is the case - that people who share stuff, buy *more* stuff. Here's some more:

The Institute for Information Law in the Netherlands reports that the average downloader buys more DVDs, music, and games than people who never download. Illegal downloaders represent 45 percent of consumers who purchase content legally, the institute recently reported.

The Institute estimates some 4.7 million Dutch Internet users 15 years and older downloaded hacked and pirated DVDs, games, and music in the last 12 months. This would imply a staggering 25 percent of the Dutch population (from the 2008 figure of 16.5 million) who view illegal downloading and sharing as socially acceptable, even as they're also legally acquiring content in parallel.

So that seems to say that 25 per cent of the Dutch population share stuff, but that they represent 45 per cent of the sales. In other words, they are buying quite a lot more than people who don't.

Perhaps one day the content industries will realise that they should be *encouraging* sharing, becuase it boost their sales: it's called marketing.

The Water Commons

One of the most valuable functions of the concept of "the commons" is that it reframes the terms in which we think of resources. For example, think of water as a commons, and you begin to realise why it really must be shared, and never owned:


One clear lesson emerges from the struggles of the world’s water warriors — water management remains a leaky endeavor unless it adheres to the principles of the commons — the gifts of society and nature that are shared by all, for generations to come. Effective water management must be based on such water commons principles as community control, democratic participation, ensuring the earth’s right to water, public water delivery and accessibility for all.

Spot the Disconnect

On the one hand, we have a bunch of people I've never heard of whingeing in the Times:


We are very concerned that the successes of the creative industries in the UK are being undermined by the illegal online file-sharing of film and TV content. At a time when so many jobs are being lost in the wider economy, it is especially important that this issue be taken seriously by the Government and that it devotes the resources necessary to enforce the law.

In 2007, an estimated 98 million illegal downloads and streams of films took place in the UK, while it is believed that more than six million people illegally file-share regularly. In relation to illegal downloads of TV programmes, the UK is the world leader, with up to 25 per cent of all online TV piracy taking place in the UK. Popular shows are downloaded illegally hundreds of thousands of times per episode.

On the other, we have this perceptive comment from TorrentFreak:

when just this year it was reported that UK commercial TV broadcasters “enjoyed a bumper April with the highest viewing figures in five years”, that total TV viewing was up 10% year-on-year, and “the valuable yet hard-to-reach 16 to 24-year-old demographic [i.e the typical file-sharer] watched 4.9% more commercial TV in April year-on-year and saw 12% more ads,” you have to wonder exactly what the problem is.

So how do we reconcile those? Well, could it be, dear Times whingers, that the Internet actually *drives* traffic to your precious films and TV programmes, whatever they are? Could it be that the Internet is actually going to keep you all employed and so fraffly well-paid?

Stars of the Screen(shot)

One of the wondrous things about free software is that there is so much of it. One of my favourite hobbies is using Synaptic to look at all the amazing goodies out there - and then download stuff, just because I can. But this richness is also something of a problem: it's hard knowing whether something is really what you are looking for.

Enter the screenshots.debian.net:

This is a public repository of screenshots taken from applications contained in the Debian GNU/Linux distribution. It was created to help getting an impression of what a certain software will look like on your desktop before you install it. Everybody can take screenshots and upload them. Our admin team will just review your changes before they become publicly visible.

I'm sure there must be some interesting mashups to be had with this resource.

Appassionato about Passionato

By now, it's evident that the old model of music distribution is irredeemably broken. This has led to various attempts to offer download services, but most of them have been horribly half-hearted, with one or more fatal flaws (and that includes iTunes, whose use of DRM means that it just doesn't cut the mustard.)

Firefox Users Against Boredom

Statistics show that Firefox Users are more inclined to have rich, exciting experiences on the web and in everyday life. Others, however, find themselves paralyzed by the death grip of boredom. It's not their fault. Many are good people who simply got off to a bad start. It's our duty to show them that the numbers can be in their favor. MuleSource Hits a Million (Downloads)

MuleSource is not the highest-profile of open source companies, but it is certainly storming away:

MuleSource (www.mulesource.com), the leading provider of open source infrastructure and integration software, today announced that Mule has surpassed the one million downloads milestone. Following an initial open source release in 2003 by creator Ross Mason, Mule has become the enterprise developer's most-used integration platform, and is currently deployed in more than 1,000 production environments worldwide. A partial list of Mule users and customers can be found at http://www.mulesource.com/customers/.

This kind of hidden success is just so typical of open source these days: there's lots going on, but only at moments like this does it surface.

High-Def, Low Interest

worrying about the high-def format war is a waste of time. And to be quite honest, I don't see these formats being around much longer anyway--movie downloads will quickly supplant media as the chosen form of entertainment once our Internet access speeds increase.

Quite. Part of the problem is that the manufacturers are more interested in "solving" the problem of copying than providing something that users want. No wonder the public doesn't really give a damn.

Firefox Hit 400 Million Downloads

This is worth quoting at length:

On November 9th, 2004, you all started a movement. Even though these are downloads, not installed versions, it's still important to note that the rate at which people are trying out or upgrading Firefox is accelerating: 100 million in one year, 200 million in two years, but 400 million in three years. It will be interesting - and indicative - to see what happens in a year's time.

Chinese Whispers

Here's another billion reasons why DRM'd music downloads will die out - and why copyright law will need to be rewritten:

Like millions of other young Chinese, he downloads them for free using Baidu.com (BIDU ), the country's biggest search engine. Baidu makes it so easy—just hit the MP3 tab on the home page, type in the name of the song, and click. What's more, Zhu doesn't believe he and his friends are doing anything wrong. "I think it's a problem with the law, not with us users," he says.

Let the Peoples Sing (Even if No One Listens)

Hey, music industry, I think the people formerly known as the audience are trying to tell you something:

Now in its fourth year, the survey - carried out by Entertainment Media Research in conjunction with media lawyers Olswang - found that 43% of UK consumers admitted to downloading music without paying for it, adding up to a hefty hike from 36% in 2006.

...

Commenting on the slowing growth of authorised downloads (up by just 15 per cent this year, compared to 40 per cent in 2006), Hart said that folks are donning their pirate’s hats and grabbing illegal downloads because official downloads are seen as too pricey.

The survey backs up that claim, with 84 per cent saying that older digital downloads should be made cheaper, while nearly half (48 per cent) said that they’d be happy to pay more for newer releases.

John Enser, Oslang’s head honcho of music, added: “The music industry needs to embrace new opportunities being generated by the increasing popularity of music on social networking sites. Surfing these sites and discovering new music is widespread with the latest generation of online consumers but the process of actually purchasing the music needs to be made easier to encourage sales and develop this new market.”
